By accessing or using the Recall MedSpa platform, dashboard, SMS automation, and associated services (collectively, the "Services") provided by Recall MedSpa ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

Recall MedSpa provides an automated missed call recovery platform for aesthetic clinics. Our Services include:

• Missed call detection and automated SMS follow-up
• Customizable SMS templates with booking links
• Real-time tracking dashboard for call recovery analytics
• Multi-location management
• Integration with Twilio telephony infrastructure

You must be at least 18 years old or the age of majority in your jurisdiction to use our Services. By using the Services, you represent and warrant that you meet these eligibility requirements.

When you create a Recall account, you are responsible for:

• Maintaining the security of your login credentials
• All activities that occur under your account
• Ensuring that your use complies with applicable laws and regulations, including telemarketing and SMS consent laws
• The accuracy of information you provide, including your clinic details and booking links

We are not responsible for any loss resulting from unauthorized access to your account due to your failure to safeguard your credentials.

You agree not to use the Services to:

• Violate any applicable laws, regulations, or third-party rights
• Distribute malware, spam, or harmful content
• Engage in fraudulent, deceptive, or manipulative activities
• Attempt to interfere with or disrupt the integrity of the Services
• Reverse engineer, decompile, or attempt to extract source code from our proprietary software
• Use the Services for money laundering or terrorist financing

Our trademarks, logos, branding, and proprietary software remain our exclusive property and may not be used without prior written consent.

Data and content you provide through the Services (such as SMS templates and clinic information) remains yours. We use it solely to deliver our Services to you.

You acknowledge that:

• SMS messages are sent to callers who have initiated contact with your clinic by calling your phone number
• You are responsible for compliance with TCPA, CAN-SPAM, and applicable telecommunications regulations
• SMS delivery depends on carrier networks and is not guaranteed
• Standard messaging rates may apply to recipients
• We do not control third-party booking systems linked in your SMS messages

Certain Services involve subscription fees based on the number of clinic locations. Fee structures are transparent and published on our pricing page. Fees may be updated with reasonable notice. You are responsible for all fees associated with your use of the Services.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECALL MEDSPA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICES.

You agree to indemnify and hold harmless Recall MedSpa, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated through our website or Services. Your continued use of the Services after changes constitutes acceptance of the updated Terms.

We may suspend or terminate your access to the Services at our discretion if you violate these Terms. Upon termination, your right to use the Services ceases immediately. You may export your call data prior to termination.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration.
